Terms and conditions (for applicants)

Welcome to BestVisa.ca. By using our website and services, you agree to the following Terms and Conditions. Please read them carefully. These Terms and Conditions form a legally binding agreement between you (“Client”) and BestVisa.ca (“Company”).

1. Acceptance of Terms

By registering on BestVisa.ca, you confirm that:

  1. You are at least 18 years of age or the legal age of majority in your jurisdiction.
  2. You have provided accurate and truthful information during registration.
  3. You will comply with all applicable laws and regulations in connection with your use of the platform.

2. Scope of Services

BestVisa.ca provides:

  1. A secure platform connecting clients with licensed Canadian immigration practitioners (“REPs”), including consultants and lawyers.
  2. Tools for communication, consultation scheduling, document exchange, and payments.
  3. Escrow-based financial services for secure transactions.
  4. A referral program, a client dashboard, and supervisory oversight to ensure professionalism and compliance.

Limitations:

  1. BestVisa.ca is not a provider of immigration or legal advice.
  2. All immigration advice and services are provided exclusively by independent licensed practitioners, who are individually responsible for their work and outcomes.

3. Client Obligations

When using BestVisa.ca, you agree to:

  1. Provide accurate and complete information in all forms, questionnaires, and communications.
  2. Refrain from uploading false, misleading, or fraudulent documents.
  3. Use the platform only for lawful purposes.
  4. Conduct all communications with practitioners through the platform to ensure security, transparency, and proper record-keeping.

Prohibited Actions:

  1. Fraud, misrepresentation, or submission of false documents.
  2. Harassment or abuse of practitioners, staff, or other users.
  3. Attempting to bypass BestVisa’s payment system or escrow process.

Failure to comply may result in suspension or termination of your account.

4. Payments and Fees

  1. Payment Process: All payments for services must be made to BestVisa.ca, not directly to practitioners.
  2. Escrow and Release: Funds are held securely by BestVisa.ca in escrow and released to the practitioner only when service milestones are reached, as set out in the client-practitioner agreement.
  3. Hourly-Based Services:
  4. When you engage a practitioner on an hourly basis, you will be required to place an initial deposit into your BestVisa account.
  5. Practitioners must complete timesheets that detail hours worked and tasks performed.
  6. Based on these timesheets, practitioners issue invoices through the platform.
  7. The invoiced amounts are deducted from your deposit, with notice and receipts provided.
  8. If your deposit balance is exhausted, you must top up your account to continue services.
  9. Service Fees: BestVisa charges practitioners administrative and operational fees under their agreement with BestVisa. Clients are not charged hidden fees.
  10. Refund Policy: Payments are generally non-refundable once services begin, except in cases where a practitioner fails to deliver. Refund disputes are handled on a case-by-case basis.

5. Client Dashboard

Upon registration, you will receive access to a secure account. Through your dashboard you can:

  1. Manage consultations, offers, and contracts.
  2. Track invoices, payments, and receipts.
  3. Monitor milestones, timesheets, and case progress.
  4. Store and review all communications securely.

You are responsible for maintaining the confidentiality of your account credentials.

6. Data Usage and Privacy

By using BestVisa.ca, you agree that:

  1. Your personal and case-related information may be shared with practitioners for service delivery.
  2. BestVisa may send you service updates, referral program details, and promotional offers (you may opt out at any time).
  3. BestVisa may securely store your information as required for regulatory, operational, and tax compliance.

7. Referral Program

  1. After successfully completing a paid service, you will receive a referral code.
  2. When a new client registers using your referral code, both you and the new client will each receive a $25 credit.
  3. Credits are accumulated in your BestVisa wallet and can be applied toward future services.
  4. You may use up to 50% of your wallet balance for any contract payment.
  5. Credits are non-transferable and non-refundable.

8. Limitation of Liability

BestVisa.ca is not liable for:

  1. The actions, advice, or results provided by practitioners.
  2. Delays, errors, or negative outcomes in immigration applications.
  3. Losses arising from technical issues, unauthorized access, or misuse of the platform.

Indemnification: You agree to indemnify and hold BestVisa.ca harmless from claims, damages, or expenses that result from your misuse of the platform.

9. Contractual Relationship with Practitioners

When you select a practitioner and accept an offer:

  1. A formal retainer contract is generated between you and the practitioner.
  2. The contract complies with the regulatory requirements of the practitioner’s governing body (e.g., CICC, Law Society).
  3. BestVisa facilitates the creation and execution of the contract but is not a party to it.

10. Termination of Services

BestVisa.ca reserves the right to suspend or terminate your account if you:

  1. Violate these Terms and Conditions.
  2. Engage in fraudulent or unlawful activity.
  3. Abuse the platform, staff, or practitioners.
  4. Fail to make required payments.

11. Dispute Resolution

  1. Disputes between clients and practitioners must first be addressed through BestVisa’s internal dispute resolution system.
  2. If unresolved, disputes may be escalated to the relevant regulatory authority (e.g., CICC, provincial law societies).

12. Amendments

BestVisa.ca may update these Terms and Conditions at any time. Clients will be notified of significant changes by email or through platform announcements. Continued use of the platform after updates constitutes acceptance of the revised terms.

13. Governing Law

These Terms and Conditions are governed by the laws of Quebec, Canada. Any disputes will be subject to the exclusive jurisdiction of the courts located in Quebec.

14. Acknowledgment

By using BestVisa.ca, you confirm that you have read, understood, and agreed to these Terms and Conditions. If you do not agree, you must immediately discontinue use of the platform.
