Refund Policy

1. General Principles
BestVisa.ca is committed to maintaining a transparent, secure, and fair environment for both immigration clients and licensed practitioners. Because immigration services involve professional expertise, regulated obligations, and significant time commitments, refunds are limited. Refund eligibility is carefully assessed in accordance with BestVisa’s contract structure, escrow system, and supervisory oversight.
BestVisa.ca itself is not the service provider of immigration or legal services. All services are delivered by independent licensed practitioners (RCICs or Canadian immigration lawyers). BestVisa’s role is to facilitate secure contracting, escrow-based payments, and regulatory supervision.
2. Who Is the Service Provider?
- All immigration services are delivered by independent licensed practitioners registered on the platform.
- BestVisa.ca verifies credentials, supervises compliance, and manages payments securely but does not provide immigration services directly.
- Refund requests relating to delivery or quality of service must be pursued within BestVisa’s framework, subject to these policies.
3. Refund Eligibility
a. Lump-Sum Contracts
- Lump-sum contracts may be structured into two or more payment milestones (e.g., initial deposit, file preparation, submission, completion).
- Initial Payments/Deposits: Non-refundable once the practitioner has begun work. Refunds may be considered only if no work was initiated or if the practitioner cancels unilaterally.
- Subsequent Milestones: Refunds may be granted if the milestone has not been completed and the delay or failure is attributable to the practitioner.
- Partial Work: If partial work was delivered before termination, only the unused portion of funds for incomplete milestones may be refunded.
b. Hourly Contracts
- Clients must deposit funds into escrow before hourly services begin.
- Practitioners complete timesheets documenting hours worked and tasks performed.
- Based on these timesheets, invoices are issued and deducted from the client’s deposit.
- Refunds may be requested for unapproved or disputed hours before funds are released to the practitioner.
- Once hours are approved and released, they are non-refundable.
4. Process for Requesting a Refund
Refund requests must be submitted through the BestVisa platform or by emailing [email protected]. Requests must include:
- Practitioner name
- Contract type (lump sum or hourly)
- Date and amount of payment
- Reason for refund request
- Supporting evidence, if applicable (e.g., failure to deliver, breach of contract)
Upon receipt, BestVisa may freeze the relevant funds in escrow while the matter is reviewed.
5. Refund Authority and Mediation
- Refunds are not automatic and must meet eligibility requirements.
- BestVisa will mediate disputes and has authority to:
- Approve a full refund where the practitioner failed to deliver any contracted services.
- Approve a partial refund where only part of the contract was completed.
- Deny refund requests that do not meet policy criteria.
- Refund determinations by BestVisa are final, subject to oversight by the relevant regulatory authority.
6. Administrative and Processing Costs
- Refunds apply only to client payments held in escrow.
- Platform-related administrative or processing costs are not refundable once milestones or hours have been processed, except in cases of fraud or clear violation of platform rules.
7. Important Limitations
- Refunds cannot be issued for:
- Government decisions or visa outcomes, even if negative.
- Differences in professional judgment, legal strategy, or interpretation of immigration law.
- Dissatisfaction where the practitioner fulfilled their contractual obligations.
- Clients are encouraged to:
- Keep all communications within the platform,
- Carefully review offers, contracts, and timesheets,
- Approve milestones only when satisfied.
8. Final Commitment
BestVisa was created to protect clients from fraud, ghost agents, and unauthorized representatives, while empowering licensed practitioners to provide legitimate, regulated services.
Our refund policy balances client protection with fairness to practitioners, ensuring that all services are delivered within a transparent, supervised, and legally compliant framework.
